Local Electric
Terms and Conditions
These terms apply to use of our website and to electrical labor, materials, estimates, scheduling, and related services provided by Local Electric unless a project-specific written agreement states otherwise.
1. Application of Terms
These terms apply to the Local Electric website and to estimates, labor, materials, equipment, and related electrical services we provide. A signed proposal, estimate, change order, or other written project agreement controls if it conflicts with these general terms.
2. Website Use
Website content is provided for general information and may be changed without notice. Information on the website is not an electrical diagnosis, safety instruction, estimate, or promise that a particular service or product is appropriate for your property. Do not use a website form for an emergency. For an immediate threat involving fire, shock, damaged electrical equipment, or another dangerous condition, keep a safe distance and contact the appropriate emergency service or utility.
3. Estimates, Authorization, and Scope
Estimates and proposals are based on information reasonably available when prepared. Pricing, quantities, and timing may change if the requested scope, site conditions, code requirements, product availability, or information supplied by the customer changes.
Work outside the agreed scope requires additional authorization and may result in additional charges or schedule changes. Verbal discussions do not modify a written scope unless confirmed by Local Electric.
4. Customer Responsibilities and Site Access
The customer will provide safe and timely access to the work area, electrical panels, utilities, equipment, and an authorized decision maker. The customer is responsible for disclosing known hazards, concealed utilities, hazardous materials, access restrictions, occupancy rules, and relevant existing conditions.
Unless included in writing, the customer is responsible for owner, landlord, association, or other third-party permissions and for protecting or moving furniture, valuables, landscaping, and other property near the work area.
5. Permits, Utilities, and Inspections
The estimate or proposal will determine who is responsible for permits, utility coordination, inspections, engineering, and third-party approvals. Permit fees, inspection fees, utility charges, engineering, and corrective work outside the agreed scope are additional unless expressly included.
Inspection or utility schedules are controlled by the applicable authority or provider and may affect completion dates.
6. Pricing, Invoices, and Payment
The accepted estimate, proposal, invoice, or other project paperwork states the applicable price, deposit, progress-payment, and payment terms. Taxes, permits, freight, special delivery, equipment rental, disposal, after-hours work, and similar charges are additional unless included in writing.
Customers must promptly identify a good-faith billing dispute and pay all undisputed amounts when due. Overdue amounts and collection remedies are governed by the project documents and applicable law.
7. Changes, Concealed Conditions, and Safety
Concealed wiring, undocumented modifications, code issues, water or structural damage, hazardous materials, inaccessible areas, utility requirements, and other conditions that were not reasonably visible may require a change in scope, price, materials, or schedule.
Local Electric may stop or decline work when conditions are unsafe, unlawful, outside the agreed scope, or likely to damage property or equipment. Necessary make-safe work may be performed and billed when authorized or reasonably required to address an immediate hazard.
8. Materials and Equipment
Products may be affected by availability, discontinuation, lead-time changes, manufacturer revisions, and price changes. Local Electric may propose a reasonably comparable substitute, subject to customer approval when the substitution materially affects the agreed work.
Special-order or customer-selected materials may be nonreturnable or subject to supplier restocking and shipping charges. Manufacturer warranties remain subject to the manufacturer's terms.
9. Scheduling and Delays
Scheduling and completion dates are estimates unless expressly guaranteed in writing. Local Electric is not responsible for delay caused by weather, emergencies, unsafe conditions, customer or third-party delay, inspections, utilities, labor disruption, material shortages, transportation problems, government action, or other circumstances beyond our reasonable control.
10. Completion, Inspection, and Concerns
The customer should inspect completed work promptly and notify Local Electric within a reasonable time of any visible defect, incomplete item, property concern, or billing question. Notice should describe the issue and allow a reasonable opportunity to inspect and, when appropriate, correct covered work.
Minor punch-list items that do not prevent safe, intended use do not postpone payment for otherwise completed work.
11. Warranty
Any Local Electric labor warranty stated in the accepted proposal, estimate, invoice, or separate warranty document controls. Warranty coverage does not include ordinary wear, misuse, abuse, unauthorized changes or repairs, customer-supplied materials, pre-existing conditions, utility problems, water or environmental damage, casualty, or product failure outside our workmanship.
Third-party products are covered only by any warranty offered by their manufacturer or supplier. Local Electric will reasonably assist with a valid manufacturer claim when included in the project agreement, but does not control the manufacturer's decision or remedy.
12. Limitation of Liability
To the fullest extent permitted by law, Local Electric is not liable for indirect, incidental, special, exemplary, or consequential damages arising from the website or our work. Any limitation or allocation of liability in a signed project agreement controls over this paragraph. Nothing in these terms excludes responsibility that cannot lawfully be excluded or limited.
13. Suspension, Cancellation, and Termination
Local Electric may suspend scheduling, deliveries, or work for nonpayment, unsafe conditions, denied access, missing approvals, material customer breach, or other circumstances that reasonably prevent performance. The customer remains responsible for authorized work performed, committed labor, nonreturnable materials, restocking charges, and other amounts allowed by the project agreement and applicable law.
14. Governing Law and Severability
These terms are governed by Vermont law, without regard to conflict-of-law rules. If any provision is found unenforceable, the remaining provisions continue to the fullest extent permitted by law. Failure to enforce a provision once does not waive the right to enforce it later.
